Terms of service

These terms apply to your use of Marginify at marginify.app, a service for estimating the landed cost and margin of imported products. In these terms, “Marginify”, “we” and “us” mean the operator of the service, and “you” means the person or business using it. By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service.

The service

Marginify calculates estimated landed costs and margins from published US and Canadian tariff schedules and the information you enter. It keeps a history of those figures and can send you alerts and summaries when tariff data or your margins change. We may add, change or remove features over time.

Estimates only

Everything Marginify shows is an estimate for planning. It is not customs, legal, tax or financial advice, and it is not a customs-compliance determination. Marginify is not a licensed customs broker.

The duty you actually owe depends on the classification, origin, value and eligibility of your goods, and on rules that change. You are responsible for the duties you pay and for checking them with a licensed customs broker or the customs authority. We do not promise that any figure, rate or alert is complete, current or free of errors, and you should not rely on Marginify as the only basis for a pricing, purchasing or compliance decision.

Your account

You must give accurate information when you sign up and keep your password private. You are responsible for everything done through your account. You must be at least 18 years old and use Marginify for business purposes. Tell us right away if you think someone has used your account without permission.

Acceptable use

You may not:

• try to access another user’s account or data;
• interfere with or disrupt the service, or try to get around its limits;
• copy, scrape or resell the service or its output by automated means; or
• enter data you do not have the right to use.

We may suspend or close an account that breaks these rules.

Plans and payment

The Free plan costs nothing. Paid plans are billed monthly in US dollars through Stripe, our payment processor, and renew automatically until you cancel. You can change or cancel your plan at any time from the billing page. A cancellation takes effect at the end of the current billing period, and you keep your paid features until then.

Payments already made are not refundable, except where the law requires a refund. Any applicable taxes are added at checkout. We may change our prices; if we do, we will give you at least 30 days’ notice before a new price applies to you. If you cancel or a payment fails, your account moves to the Free plan. Your data is kept, and tracking and alerts stop.

Your data

You own the data you put into Marginify. You give us permission to store and process it only to run the service for you. Our privacy policy explains what we collect and how we handle it, and our security page explains how we protect it. You can export your products at any time, and you can delete your account from Settings.

Availability

We try to keep Marginify running, but we do not guarantee that it will always be available or free of errors. Tariff data comes from government sources that we do not control and that may be late, incomplete or wrong.

Disclaimer

To the extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, for lost profits, revenue or data, or for any loss that results from relying on an estimate. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose, or 100 US dollars if you have not paid us anything.

Ending your use

You can stop using Marginify and delete your account at any time. We may suspend or end your access if you break these terms. The sections on estimates, the disclaimer, the limitation of liability and governing law continue to apply after your account ends.

Changes to these terms

We may update these terms. When we do, we will change the date at the top of this page, and for significant changes we will tell you by email or in the app before they take effect. If you keep using Marginify after a change, you accept the updated terms.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
